DMCA Policy for Pif Taiwan Membership
Pif Taiwan Membership respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which may be found on the U.S. Copyright Office website, Pif Taiwan Membership will respond expeditiously to claims of copyright infringement committed using the Pif Taiwan Membership service and/or website (the "Site") if such claims are reported to Pif Taiwan Membership's Designated Copyright Agent as described below.
This policy outlines the procedure for filing a copyright infringement notice and for filing a counter-notification when you believe your material has been wrongly removed.
Filing a DMCA Notification of Claimed Infringement
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing a DMCA Notification of Claimed Infringement and delivering it to Pif Taiwan Membership's Designated Copyright Agent. Upon receipt of the Notice as described below, Pif Taiwan Membership will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.
Your DMCA Notice of Claimed Infringement must be a written communication provided to the Designated Copyright Agent and must include substantially the following:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Pif Taiwan Membership to locate the material.
- Information reasonably sufficient to permit Pif Taiwan Membership to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the complaining party.
Filing a DMCA Counter-Notification
If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with Pif Taiwan Membership by submitting a written communication to our Designated Copyright Agent, which includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Pif Taiwan Membership may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, Pif Taiwan Membership will provide the complaining party with a copy of the counter-notification and inform them that Pif Taiwan Membership will replace the removed material or cease disabling access to it in 10 business days. Pif Taiwan Membership will replace the removed material and cease disabling access to it in 10 to 14 business days after receipt of the counter-notification, unless Pif Taiwan Membership's Designated Copyright Agent first receives notice from the complaining party that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on Pif Taiwan Membership's system or network.
